Agreement and Scope
These Terms of Service ("Terms") govern your use of the Vtrail mobile application, related API services, and the marketing website at vtrail.me (collectively, the "Service"), operated by Usermade, Inc. ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Eligibility
You must be at least 13 years of age to use the Service. If you are under 18, you should have your parent or guardian review these Terms. By using the Service, you represent that you meet these requirements.
Account
To use certain features, you must register for an account. You agree to provide accurate and complete information and to keep your account credentials secure. You are responsible for all activity under your account.
Acceptable Use
You agree not to use the Service to: (a) violate any applicable law or regulation; (b) infringe the rights of others; (c) transmit harmful, offensive, or illegal content; (d) attempt to gain unauthorized access to the Service, other accounts, or our systems; (e) interfere with or disrupt the Service or our infrastructure; (f) reverse engineer, decompile, or disassemble the Service except as permitted by law; or (g) use the Service for any purpose that is fraudulent or otherwise prohibited by these Terms.
User Content and License
You retain ownership of the content you create using the Service, including recordings. By using the Service, you grant us a limited, non-exclusive license to store, transmit, and process your content solely to provide and operate the Service (for example, to sync your recordings to the cloud and display them on your devices). We do not use your content for marketing or other purposes unrelated to providing the Service.
Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the practices described in the Privacy Policy. The Privacy Policy is available at /privacy/ on this website.
Service Modifications
We may change, suspend, or discontinue the Service or any part of it at any time. We will try to give notice when reasonably practicable, but we are not obligated to do so. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
Paid Services
The Service is currently offered free of charge. We may introduce paid plans or features in the future. If we do, the applicable fees, payment terms, refund policy, and any additional conditions will be communicated at the time of offering or in separate terms.
Termination
We may suspend or terminate your access to the Service, or delete your account, if we believe you have violated these Terms or for other operational or legal reasons. You may delete your account at any time using the account deletion feature in the app (password verification required) or by submitting an email deletion request (no password verification required). Upon account deletion, your data will be handled as described in our Privacy Policy. Please note that for email-based deletion requests, to prevent fraudulent deletions, account deletion will be carried out one month after the request is received. If the account is used during this one-month period, the deletion request will be cancelled.
Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by applicable law, we and our affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service or these Terms. Our total liability for any claims arising from or related to the Service or these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred US dollars (USD 100), whichever is greater. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability will be limited to the fullest extent permitted by law.
Changes to Terms
We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Your continued use of the Service after the changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and may delete your account.
Governing Law and Jurisdiction
These Terms shall be governed by the laws of Japan, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
